{"id":9582,"date":"2022-01-01T12:44:05","date_gmt":"2022-01-01T11:44:05","guid":{"rendered":"https:\/\/hosteleo.com\/blog\/?p=9582"},"modified":"2022-01-01T12:44:07","modified_gmt":"2022-01-01T11:44:07","slug":"las-claves-y-los-contratos-de-la-nueva-reforma-laboral-de-2022","status":"publish","type":"post","link":"https:\/\/hosteleo.com\/blog\/las-claves-y-los-contratos-de-la-nueva-reforma-laboral-de-2022\/","title":{"rendered":"Las claves y los contratos de la nueva reforma laboral de 2022"},"content":{"rendered":"\n<p>El pasado 31 de diciembre ha entrado en vigor la nueva reforma del mercado de trabajo, pactada por el Gobierno y los Agentes Sociales tras su publicaci\u00f3n en el<a href=\"https:\/\/www.boe.es\/\"> Bolet\u00edn Oficial del Estado. <\/a>A pesar de ser publicada ayer, las empresas tendr\u00e1n hasta 3 meses para adaptarse a ella.<strong> A continuaci\u00f3n, te explicaremos las claves y los nuevos tipos de contratos de la nueva reforma laboral de 2022.<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Las claves de la nueva reforma laboral<\/h2>\n\n\n\n<p>La Ministra de Trabajo Yolanda D\u00edaz, ha dejado claras<strong> las nuevas modificaciones y claves que se pondr\u00e1n en vigor en esta reforma laboral:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Uno de los objetivos que se busca es<strong> frenar las temporalidades en los contratos<\/strong> de trabajo.<\/li><li>Para conseguir este objetivo, se pone <strong>fin a los contratos por obra y servicio.<\/strong><\/li><li>Los contratos de duraci\u00f3n <strong>determinada se reducen a dos tipos: estructural,<\/strong> producido por circunstancias de construcci\u00f3n y con una duraci\u00f3n m\u00e1xima de 6 meses, y el de <strong>sustituci\u00f3n, <\/strong>que podr\u00e1 realizarse hasta que el trabajador vuelva a incorporarse.<\/li><li>Las empresas podr\u00e1n realizar tambi\u00e9n <strong>contrataciones temporales en las \u00e9pocas de m\u00e1s demanda pero solamente tienen derecho a 90 d\u00edas anuales.<\/strong><\/li><li>Las empresas deben <strong>modificar los contratos de sus trabajadores antes del 30 de marzo<\/strong> para evitar sanciones y cumplir con la nueva reforma.<\/li><li><strong>Las sanciones pueden llegar a los 10.000 euros <\/strong>por trabajador en caso de incumplimientos en sus contratos.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Los tipos de contrato<\/h2>\n\n\n\n<p>Como hemos mencionado, las claves y los contratos de la nueva reforma laboral de 2022, han dejado <strong>las siguientes modificaciones y modalidades en los tipos de contratos:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Contrato de trabajo fijo-discontinuo. <\/strong>Este tipo de contrato se queda limitado para aquellas empresas que realizan sus labores con car\u00e1cter estacional. En el momento que finalizan el contrato, la compa\u00f1\u00eda debe recolocarlo en otra empresa o bien realizarle un per\u00edodo de formaci\u00f3n. Por otro lado, si el trabajador tiene contratos de este tipo acumulados durante un a\u00f1o y medio en la misma empresa, pasar\u00e1 autom\u00e1ticamente a tener un contrato indefinido.<\/li><li><strong>Contrato temporal o de duraci\u00f3n determinada.<\/strong> Como hemos comentado anteriormente, este tipo de contratos se ver\u00e1n reducidos a dos causas justificadas como son circunstancias de la producci\u00f3n o bien por sustituci\u00f3n. Esta causa deber\u00e1 quedar reflejada en el contrato de trabajo. Los trabajadores que incumplan la duraci\u00f3n o las causas de este tipo de contratos, pasar\u00e1n a ser indefinidos.<\/li><li><strong>Contratos de formaci\u00f3n.<\/strong> En \u00e9l, se introduce una nueva modalidad como es el contrato de <strong>formaci\u00f3n en alternancia. <\/strong>Una de las condiciones de este tipo de contrato es que su duraci\u00f3n no puede superar los dos a\u00f1os y adem\u00e1s el trabajador debe ser menor de 30 a\u00f1os. Con esta nueva modalidad, se busca que los trabajadores puedan compaginar el trabajo con sus estudios.
